Booking terms

1. Seller

The dinner is organised and sold by Il Giardino S.r.l., registered office Calata Ponticello a Marechiaro, 19, 80123 Napoli, VAT no. 08040881214 (the "Restaurant"). Contact: phone 081 575 1165, e-mail ilgiardinomarechiaro@yahoo.it.

2. What you book and the price

2.1 A booking entitles you to attend dinner on Thursday, 31 December 2026 at the Restaurant, Calata Ponticello a Marechiaro, 32, 80123 Napoli, arriving from 20:00, in the room you chose. The menu and the wines included are shown on each room's page.

2.2 The price is per person and depends on the room; it is shown on each room's page and in the booking form. The total price (price per person × number of people) is shown before you book and repeated in the booking e-mail. Prices include VAT, cover charge and service. Drinks not listed in the menu are paid separately on the night.

2.3 There is no reduced price for children: everyone attending, babies included, must be counted in the number of people and pays the full price.

3. Booking and payment

3.1 You book on the website by choosing the room, the number of people and giving your contact details, and you accept these terms and the privacy notice. You receive by e-mail a booking code (e.g. CAP-0042) and the Restaurant's bank details.

3.2 The total price is paid in advance, in full, by instant bank transfer (SEPA Instant) only, with the booking code in the payment reference. The payment is an advance payment of the whole price: it is not a part payment or a deposit. A standard transfer may arrive after the deadline: in that case article 3.7 applies.

3.3 Seats are held for 48 hours after booking and in any case no later than 31 December 2026 at 16:00. If the transfer has not been received by then, the booking expires and the seats become available again.

3.4 A booking is confirmed only once payment is received. You then receive a confirmation e-mail, to show at the entrance together with the booking code or your name.

3.5 Online bookings close on 30 December 2026 at 23:59, or earlier if the seats are sold out.

3.6 Any fees charged by your bank are paid by you. If the amount received is less than the total, the booking is confirmed only once the difference has been paid, within the same deadline (article 3.3).

3.7 If the transfer arrives after the deadline, the booking is confirmed if seats are still available in the chosen room; otherwise the amount is refunded in full within 15 days of receipt. Any amount paid in excess is also refunded within 15 days of receipt.

3.8 The Restaurant issues the till receipt (scontrino) required by law. If you need an invoice for a company, request it in the booking form with your billing details, or send the same details to ilgiardinomarechiaro@yahoo.it before confirmation.

4. Cancellations and changes by the customer

4.1 You can cancel your booking by writing to ilgiardinomarechiaro@yahoo.it with your booking code. If you cancel by 15 November 2026, you get a full refund (article 5). After that date, a cancellation by the customer gives no right to any refund of the amount paid. The same applies if you do not attend.

4.2 Reducing the number of people counts as a partial cancellation: by 15 November 2026, the people removed are refunded in full (article 5); after that date it gives no right to any refund. Adding people counts as a new booking, subject to available seats.

4.3 You can transfer your booking to another person free of charge by sending their name to ilgiardinomarechiaro@yahoo.it by 20 December 2026 at 23:59.

4.4 You can ask by e-mail to move to a higher-category room, if seats are available, by paying the price difference by instant bank transfer. Moving to a lower-category room is not possible.

5. Right of withdrawal

The right of withdrawal under the Italian Consumer Code (Legislative Decree 206/2005) does not apply, as this is a service with a specific date (article 59(1)(n)). The Restaurant nevertheless allows you to withdraw by e-mail to ilgiardinomarechiaro@yahoo.it by 15 November 2026 (46 days before the event on Thursday, 31 December 2026), with a full refund of the amount paid within 15 days of your notice. After that date article 4 applies.

6. Cancellation by the Restaurant

If the Restaurant cancels the event or the booking, for any reason (including force majeure and orders from the authorities), it refunds the amounts paid in full within 15 days of the cancellation and in any case no later than 15 January 2027.

7. Refunds

Refunds under these terms (articles 3.7, 5 and 6) are made by bank transfer to the same account (IBAN) the payment was received from, within the time stated in each article.

8. Allergies and dietary requirements

Please tell us about any allergies, intolerances or dietary requirements by replying to the booking e-mail, at least 7 days before the event. The list of allergens in each dish is available on request, by e-mail, before you book.

9. Personal data

10. Complaints and jurisdiction

Complaints can be sent to ilgiardinomarechiaro@yahoo.it. The contract is governed by Italian law. For disputes with consumers, the courts of the consumer's place of residence or domicile have jurisdiction (article 66-bis of the Italian Consumer Code).
